Federal policy

CMS uses CHOICE Arrangements as a name for ICHRA. Read what the naming announcement means and how the September Georgia initiative adds employer implementation support without itself creating a new federal rule.

CMS now calls an individual coverage HRA (ICHRA) a CHOICE Arrangement. [What changed with the CHOICE name?](https://ichrareport.com/guides/choice-arrangements/) ([CMS terminology](https://www.cms.gov/marketplace/employer-initiatives))

The development

Federal agencies are now using CHOICE Arrangements as the public-facing name for individual coverage HRAs. Employers researching ICHRA should search both names and keep the governing plan rules attached to the terminology.

## What the agencies announced

The Small Business Administration announced the CHOICE initiative on September 3. CMS’s employer resources, modified September 10, identify CHOICE Arrangements as previously known as ICHRAs. The resources describe employer contributions toward employees’ individual insurance. The reviewed announcement establishes a naming and education development. It is not evidence that Congress enacted a replacement ICHRA statute that day. The underlying HRA integration rules remain the starting point for understanding notice, classes, qualifying coverage and opt-out obligations. [source](https://www.irs.gov/irb/2019-28_IRB)

## September 14–15 update: support beyond the new name

CMS's September 14 announcement connects the CHOICE initiative with Georgia Access For Business and additional employer resources on costs, contribution design and administration. Georgia's insurance commissioner published a separate program announcement on September 15. The new evidence extends this story from naming into practical implementation support; neither announcement itself establishes a new federal ICHRA rule. Our [Georgia Access For Business explainer](https://ichrareport.com/news/georgia-access-for-business-ichra/) covers the program's scope, QSEHRA limitation, disclosed partners and questions an employer should ask. Treat the agencies' promotional cost statements as their position, not as independently measured employer savings. ## September 21 source update: both names now appear within Pennie

Pennie's current explainer uses CHOICE and displays an updated timestamp of September 21, 2026. A separate Pennie document-submission page still tells people eligible for an individual coverage HRA (ICHRA) or QSEHRA to provide the employer notice. That is direct evidence of mixed terminology within one state Marketplace, not evidence that Pennsylvania created a new benefit or renamed every workflow. [source](https://help.pennie.com/hc/en-us/articles/26247770275991-What-is-a-CHOICE) [source](https://help.pennie.com/hc/en-us/articles/360058740073-Submitting-documents-to-confirm-a-Qualifying-Life-Event-QLE)

The visible update time does not establish when Pennie first adopted the CHOICE wording. Employers and employees should search both names and keep the actual notice, coverage date, allowance, eligible expenses and opt-out conditions attached to the benefit they were offered.

## What employers and brokers should do next

Keep both terms in the next employee communication: “Individual Coverage HRA (ICHRA), described in current CMS resources as a CHOICE Arrangement.” That gives employees a way to connect a familiar benefits notice with newer government and state-Marketplace material without implying that they have received a different insurance policy.

For a renewal project, ask the administrator to identify whether any proposed document changes are terminology updates or substantive plan changes. A new label alone does not resolve the employer’s contribution amount, the local plan menu, an employee’s prescription coverage or the work required to enroll.

It is also a useful time to review how the employer explains the benefit. The contribution is a budget for eligible reimbursements. The employee still needs to understand the actual insurance policy selected with that budget. A description that stops at “more choice” leaves the practical decision unfinished.

## A wider starting point for provider discovery

CMS now links a third-party administrator information sheet from its employer resources. It can help a buyer discover additional organizations. ICHRA Report does not treat presence in that sheet as a comparative quality score or a substitute for reviewing contractual scope. [source](https://www.cms.gov/files/document/choice-arrangement-third-party-administrator-information.pdf)

Use the same questions for every candidate: who owns notices, enrollment help, premium payments, reconciliation and coverage problems? The answers should be specific to the employer’s states and workforce.

## What to watch next

Further agency instructions could change the practical implementation picture. Our [federal policy watch](https://ichrareport.com/research/ichra-federal-policy-watch-2026/) separates agency guidance from congressional proposals.
