CMS adopts the CHOICE name for ICHRA

What the September CHOICE announcement changes in public guidance, and why employers should still check the underlying ICHRA rules.

The development

Federal agencies are now using CHOICE Arrangements as the public-facing name for individual coverage HRAs. Employers researching ICHRA should search both names and keep the governing plan rules attached to the terminology.

What the agencies announced

The Small Business Administration announced the CHOICE initiative on September 3. CMS’s employer resources, modified September 10, identify CHOICE Arrangements as previously known as ICHRAs. The resources describe employer contributions toward employees’ individual insurance. source source

The reviewed announcement establishes a naming and education development. It is not evidence that Congress enacted a replacement ICHRA statute that day. The underlying HRA integration rules remain the starting point for understanding notice, classes, qualifying coverage and opt-out obligations. source

What employers and brokers should do

Keep both terms in the next employee communication: “Individual Coverage HRA (ICHRA), described in current CMS resources as a CHOICE Arrangement.” That gives employees a way to connect a familiar benefits notice with newer government material without implying that they have received a different insurance policy.

For a renewal project, ask the administrator to identify whether any proposed document changes are terminology updates or substantive plan changes. A new label alone does not resolve the employer’s contribution amount, the local plan menu, an employee’s prescription coverage or the work required to enroll.

It is also a useful time to review how the employer explains the benefit. The contribution is a budget for eligible reimbursements. The employee still needs to understand the actual insurance policy selected with that budget. A description that stops at “more choice” leaves the practical decision unfinished.

A wider starting point for provider discovery

CMS now links a third-party administrator information sheet from its employer resources. It can help a buyer discover additional organizations. ICHRA Report does not treat presence in that sheet as a comparative quality score or a substitute for reviewing contractual scope. source

Use the same questions for every candidate: who owns notices, enrollment help, premium payments, reconciliation and coverage problems? The answers should be specific to the employer’s states and workforce.
